Driver Terms

These Driver Terms ("Terms") constitute a legally binding agreement between you and HopNGo Inc. governing your access to and use of the HopNGo Platform as a Driver. By clicking "I accept" or by accessing or using the Driver App, you confirm your agreement to be bound by these Terms.
Please read these Terms carefully before creating a Driver Account. These Terms supplement the general Terms of Service that apply to all users of the HopNGo Platform.
1. Driver Eligibility and Requirements
To be eligible to use the HopNGo Platform as a Driver, you must:
- Be at least 21 years of age;
- Possess a valid driver's license for the province in which you operate;
- Have a minimum of three (3) years of licensed driving experience in Canada;
- Own or have authorized use of a vehicle that meets HopNGo's vehicle requirements;
- Maintain valid automobile insurance that meets the minimum requirements in your province;
- Have a clean driving record and criminal background, subject to HopNGo's screening and approval process;
- Complete any required safety or orientation training as specified by HopNGo from time to time;
- Maintain an average rating that meets HopNGo's minimum standards;
- Have a valid GST/HST registration number, if applicable based on your earnings; and
- Comply with all applicable laws and regulations regarding the provision of transportation services.
HopNGo reserves the right to add to, modify, or waive any of the above requirements at its sole discretion, and to deny or revoke access to the HopNGo Platform for any Driver who fails to meet or maintain these requirements.
2. Driver Services
Upon acceptance of a Ride Request, you agree to provide transportation services to Riders in accordance with these Terms and all applicable laws and regulations. You agree to:
- Accept Ride Requests made through the HopNGo Platform when you are logged in and available;
- Navigate to the pickup location specified in the Ride Request within a reasonable time;
- Verify the identity of the Rider before starting the trip;
- Transport the Rider to their requested destination in a safe, efficient, and professional manner;
- Follow the route suggested by the HopNGo App unless the Rider requests a different route;
- Maintain the cleanliness and good working condition of your vehicle;
- Provide a professional, courteous, and respectful experience to all Riders;
- Comply with all traffic laws, regulations, and safety requirements;
- Not discriminate against any Rider on the basis of destination, race, color, age, gender, sexual orientation, gender identity, disability, medical condition, religion, national origin, or any other characteristic protected under applicable law;
- Not engage in any behavior that could be considered harassment, intimidation, or abuse of a Rider; and
- Not transport more passengers than your vehicle's legal capacity or the number permitted by law.
3. Independent Contractor Status
You acknowledge and agree that:
- You are an independent contractor and not an employee, agent, joint venturer, or partner of HopNGo;
- You have the sole discretion to determine when and for how long you will use the HopNGo Platform;
- You have the sole discretion to accept or decline any particular Ride Request, subject to HopNGo's policies on minimum acceptance rates;
- You are free to provide transportation services outside of the HopNGo Platform;
- HopNGo does not control you or your activities while using the HopNGo Platform, except as specifically described in these Terms;
- You are solely responsible for determining the manner and means of providing the transportation services;
- You are solely responsible for all costs and expenses related to your provision of transportation services, including vehicle costs, fuel, maintenance, insurance, and taxes;
- You are responsible for paying all applicable taxes on income earned through the HopNGo Platform, including income tax and GST/HST where applicable; and
- You are not entitled to workers' compensation, unemployment insurance, employer-provided health insurance, or other employee benefits.
4. Payment and Fees
As compensation for your provision of transportation services to Riders, you will receive payment as follows:
- The fare for each completed ride will be calculated based on time, distance, base fare, demand, and other factors as determined by HopNGo;
- HopNGo will collect the fare from the Rider on your behalf;
- HopNGo will deduct its service fee, which is a percentage of the fare as communicated to you from time to time;
- The remaining amount will be paid to you according to the payment schedule set forth in the Driver App;
- You may also receive tips from Riders, which will be passed on to you in full without any deduction by HopNGo;
- Payments will be made to your designated bank account via direct deposit;
- You are responsible for maintaining accurate bank account information in the Driver App;
- HopNGo reserves the right to withhold payment or deduct amounts from future payments if:
- A Rider files a complaint and is issued a refund;
- HopNGo determines that you have violated these Terms;
- HopNGo determines that you engaged in fraudulent activity; or
- HopNGo is required to do so by law or court order.
- HopNGo will provide you with an earnings statement detailing rides completed, fares collected, fees deducted, and payments made.
HopNGo reserves the right to change the fare calculation method, service fee percentage, or any other aspect of the payment structure upon notice to you. Your continued use of the HopNGo Platform after such notice constitutes your acceptance of the changes.
5. Ratings and Quality Standards
To maintain the quality of the HopNGo Platform, you acknowledge and agree that:
- Riders may rate your services and provide feedback after each ride;
- HopNGo may use these ratings and feedback to evaluate your performance;
- You must maintain a minimum average rating as established by HopNGo, which may vary by region;
- Failure to maintain the minimum average rating may result in deactivation of your Driver Account;
- HopNGo reserves the right to terminate your access to the HopNGo Platform if you fail to meet quality standards;
- You may also rate and provide feedback on Riders; and
- HopNGo may use this feedback to improve the overall quality and safety of the HopNGo Platform.
6. Insurance and Liability
You understand and agree that:
- You must maintain automobile insurance that meets or exceeds the requirements of the province in which you operate;
- Your personal automobile insurance may not provide coverage for commercial activities such as using your vehicle to transport passengers for payment;
- HopNGo does not provide any insurance coverage for your use of the HopNGo Platform. You are solely responsible for maintaining adequate insurance coverage for your use of the HopNGo Platform.
- You are solely responsible for any damage to your vehicle or other property, regardless of cause;
- You are solely responsible for any bodily injury to yourself or any third party, regardless of cause;
- You agree to indemnify and hold HopNGo harmless from any claims, damages, or liabilities arising from your provision of transportation services; and
7. Term and Termination
These Terms commence when you create a Driver Account and continue until terminated as follows:
- You may terminate these Terms at any time by providing written notice to HopNGo and closing your Driver Account;
- HopNGo may terminate these Terms and your access to the HopNGo Platform at any time for any reason, with or without cause, and with or without notice;
- HopNGo may temporarily suspend your access to the HopNGo Platform if:
- You fail to maintain the required rating;
- HopNGo receives serious complaints from Riders;
- You fail to maintain required insurance or vehicle standards;
- You violate any provision of these Terms; or
- HopNGo is investigating potential violations or suspicious activity.
- Upon termination:
- You must cease all use of the HopNGo Platform;
- You must return any HopNGo property in your possession;
- HopNGo will settle any outstanding payments due to you; and
- Sections of these Terms that by their nature should survive termination will survive termination.
8. Cancellation Policy
Drivers may cancel trips with valid reasons 1. Excessive cancellations may affect driver rating 2. Cancellation fees may apply in certain cases 3 . Emergency cancellations must be reported,
9.Intellectual Property
The App and its contents are protected by intellectual property laws. You may not: Copy or modify the App, Use the App for unauthorized purposes, Reverse engineer the App, Remove any copyright notices
10. Modifications to Terms
HopNGo reserves the right to modify these Terms at any time by posting the revised Terms on the HopNGo website or within the Driver App. Your continued use of the HopNGo Platform after such posting constitutes your acceptance of the revised Terms. If any modification is unacceptable to you, your only recourse is to terminate these Terms as described above. HopNGo will make reasonable efforts to notify you of material changes to these Terms.
